SHIPPING POLICY

At Okamura Kankitsu Farm, we take great care in harvesting, packing, processing, and shipping our products. Due to the perishable nature of many products, customers agree to the following terms and conditions upon placing an order.

1. PROCESSING AND SHIPMENT

Orders are typically processed and shipped within the estimated timeframe provided at checkout. Processing and shipping times may vary due to harvest schedules, seasonal conditions, weather events, carrier availability, customs procedures, agricultural inspections, public holidays, government regulations, labor shortages, transportation disruptions, or other unforeseen circumstances.

All shipping and delivery dates are estimates only and are not guaranteed.

Okamura Kankitsu Farm reserves the right to delay, postpone, split, consolidate, substitute packaging, limit quantities, or cancel shipments when necessary.

2. HARVEST, SEASONALITY, AND AVAILABILITY

All products are subject to seasonal availability and harvest conditions.

Because our products are grown and produced from natural agricultural sources, availability may be affected by weather, crop yields, disease pressure, natural disasters, labor availability, and other factors beyond our control.

If a product becomes unavailable after purchase, our sole obligation shall be limited to refunding the purchase price paid for the unavailable item.

3. NATURAL AGRICULTURAL PRODUCT DISCLAIMER

Fresh fruit, processed fruit products, fruit by-products, preserves, juices, dried fruit products, and all other agricultural products sold by Okamura Kankitsu Farm are natural products.

Customers acknowledge and accept that:

• Product size, shape, color, weight, sweetness, acidity, texture, aroma, shelf life, and appearance may naturally vary.
• Product photographs are representative only and may not exactly reflect the products received.
• Cosmetic imperfections, surface blemishes, color variations, rind markings, and natural irregularities are normal agricultural characteristics.
• Seasonal and environmental conditions may influence product characteristics.

Such variations do not constitute defects and are not grounds for refunds, replacements, chargebacks, or claims.

4. WEIGHT AND QUANTITY VARIANCE

Because agricultural products are naturally variable, packaged weights, counts, dimensions, and quantities may vary slightly from stated amounts.

Reasonable variations shall not constitute a defect or entitle the customer to compensation.

5. RISK OF LOSS

To the fullest extent permitted by applicable law, ownership and risk of loss transfer to the customer when the shipment is delivered to and accepted by the carrier.

Once the carrier has accepted possession of the shipment, Okamura Kankitsu Farm shall not be responsible for:

• Loss
• Theft
• Delay
• Misdelivery
• Carrier negligence
• Mishandling
• Damage during transport
• Customs delays
• Government inspections
• Product deterioration during transit
• Weather-related issues
• Transportation disruptions
• Any event beyond our reasonable control

6. PERISHABLE PRODUCTS

Fresh fruit and other perishable products are particularly sensitive to handling and transit conditions.

Customers acknowledge that:

• Fruit may continue to ripen during shipment.
• Transit duration may affect product quality.
• Temperature fluctuations may affect freshness and shelf life.
• Delays caused by carriers, customs authorities, inspections, weather, or governmental agencies may impact product condition.

Fresh produce, citrus fruit, and other perishable products are shipped at the customer's risk once tendered to the carrier.

Product quality may be affected by transit duration, handling, customs inspections, environmental conditions, and storage practices beyond the control of Okamura Kankitsu Farm.

Accordingly, Okamura Kankitsu Farm does not guarantee condition, freshness, shelf life, appearance, suitability, merchantability, or quality upon arrival except where required by applicable law.

7. DELIVERY DELAYS

Delivery dates are estimates only and are not guaranteed.

Okamura Kankitsu Farm shall not be liable for delays caused by:

• Weather conditions
• Customs inspections
• Government actions
• Carrier delays
• Transportation disruptions
• Labor disputes
• Natural disasters
• Acts of God
• Public emergencies
• Agricultural inspections
• Any circumstance beyond our control

No refunds, replacements, credits, or compensation shall be provided solely because a shipment arrives later than expected.

8. INTERNATIONAL SHIPMENTS

Customers are solely responsible for understanding and complying with all import requirements applicable to their destination country.

Customers acknowledge and accept responsibility for:

• Import permits
• Customs requirements
• Agricultural restrictions
• Quarantine requirements
• Duties
• Taxes
• Tariffs
• Brokerage fees
• Government fees
• Compliance with local laws

Okamura Kankitsu Farm makes no representation or warranty regarding the legality or eligibility of importing products into any jurisdiction.

9. CUSTOMS, AGRICULTURAL INSPECTION, AND QUARANTINE

International shipments may be subject to customs inspections, agricultural inspections, quarantine procedures, fumigation requirements, entry restrictions, or destruction by government authorities.

Customers acknowledge and accept that products may be:

• Delayed
• Opened
• Inspected
• Refused
• Returned
• Seized
• Destroyed

by customs, agricultural, quarantine, or regulatory authorities.

Okamura Kankitsu Farm shall not be liable for losses resulting from such actions.

10. NO GUARANTEE OF IMPORT ELIGIBILITY

Import regulations vary by country and may change without notice.

Customers are solely responsible for determining whether products may legally enter their country or jurisdiction.

No refunds, replacements, or compensation shall be provided if a shipment is refused, delayed, confiscated, destroyed, or otherwise affected by destination-country regulations.

11. DELIVERY TEMPERATURE DISCLAIMER

Certain products may be sensitive to temperature fluctuations during transport.

Although reasonable packaging measures may be used, Okamura Kankitsu Farm does not guarantee any specific temperature conditions during shipment.

We shall not be liable for quality changes, spoilage, deterioration, or other effects resulting from transportation conditions beyond our control.

12. INCORRECT ADDRESSES

Customers are solely responsible for providing accurate shipping information.

Okamura Kankitsu Farm shall not be responsible for losses resulting from:

• Incorrect addresses
• Incomplete addresses
• Delivery refusal
• Failure to receive packages
• Failure to collect packages
• Customs holds
• Carrier storage fees

Any reshipment requested by the customer may require payment of additional shipping charges.

13. CUSTOMER RESPONSIBILITY UPON DELIVERY

Customers should inspect all products immediately upon delivery.

Claims regarding shipping errors, shortages, visible damage, or incorrect products must be submitted within forty-eight (48) hours of delivery.

Failure to notify us within this period shall constitute acceptance of the shipment as delivered.

14. DAMAGED SHIPMENTS

If a shipment arrives visibly damaged, customers should:

• Photograph the shipment immediately.
• Retain all packaging materials.
• Notify both the carrier and Okamura Kankitsu Farm within forty-eight (48) hours.

Failure to provide sufficient documentation may result in denial of any claim.

Compensation for shipping-related damage shall be limited to any amount recoverable from the carrier or applicable shipping insurance.

15. LOST SHIPMENTS

If tracking information indicates successful delivery, Okamura Kankitsu Farm shall not be responsible for theft, loss, or disappearance after delivery.

For shipments believed to be lost in transit, we may assist with carrier claims but do not guarantee reimbursement, replacement, or recovery.

16. REFUNDS, REPLACEMENTS, AND CANCELLATIONS

Due to the perishable nature of many products, all sales are final unless otherwise required by law.

Refunds, credits, replacements, or cancellations may be granted solely at the discretion of Okamura Kankitsu Farm.

We reserve the right to require:

• Photographs
• Packaging evidence
• Product samples
• Carrier documentation
• Inspection reports

before considering any claim.

17. SHIPPING INSURANCE

Where shipping insurance is offered, customers may elect to purchase such coverage.

If shipping insurance is declined, customers assume the risk of loss, theft, damage, delay, spoilage, and non-delivery to the fullest extent permitted by law.

18. CHARGEBACKS AND PAYMENT DISPUTES

Customers agree to contact Okamura Kankitsu Farm before initiating a chargeback or payment dispute.

Shipment records, carrier tracking information, customs records, photographs, and communications may be used to contest chargebacks.

Customers acknowledge that proof of shipment, carrier acceptance, customs processing, or delivery confirmation may constitute evidence that contractual obligations have been fulfilled.

19. NO WARRANTY

Except where prohibited by law, all products are sold "AS IS" and "AS AVAILABLE."

Okamura Kankitsu Farm expressly disclaims all warranties, whether express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Continuous availability
• Uninterrupted delivery

20. LIMITATION OF REMEDIES

The customer's exclusive remedy for any claim shall be limited, at Okamura Kankitsu Farm's sole discretion, to:

(a) Replacement of the affected product; or
(b) Refund of the purchase price paid for the affected product.

No other remedies shall be available.

21. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Okamura Kankitsu Farm's total liability arising from any order, shipment, product, or transaction shall not exceed the amount actually paid by the customer for the affected product.

Under no circumstances shall Okamura Kankitsu Farm be liable for:

• Indirect damages
• Incidental damages
• Consequential damages
• Special damages
• Punitive damages
• Lost profits
• Business interruption
• Loss of opportunity
• Emotional distress
• Reputational harm

whether arising in contract, tort, negligence, strict liability, or otherwise.

22. FORCE MAJEURE

Okamura Kankitsu Farm shall not be liable for delays, failures, or inability to perform resulting from circumstances beyond our reasonable control, including but not limited to:

• Natural disasters
• Earthquakes
• Typhoons
• Floods
• Fires
• Disease outbreaks
• Pandemics
• Government actions
• War
• Terrorism
• Transportation disruptions
• Labor shortages
• Utility failures
• Agricultural emergencies

23. INDEMNIFICATION

Customers agree to indemnify, defend, and hold harmless Okamura Kankitsu Farm, its owners, employees, agents, affiliates, successors, and representatives from any claims, liabilities, losses, damages, costs, expenses, fines, penalties, or legal fees arising from:

• Importation of products
• Violation of local laws
• Regulatory actions
• Customer misuse of products
• Information provided by customers
• Customs actions
• Government enforcement actions

24. GOVERNING LAW

These terms and conditions shall be governed by and construed in accordance with the laws of Japan.

25. JURISDICTION

Any dispute arising out of or relating to any purchase, shipment, product, service, or transaction with Okamura Kankitsu Farm shall be subject to the exclusive jurisdiction of the courts located in Yamaguchi Prefecture, Japan.

26. ACCEPTANCE OF TERMS

By placing an order, the customer acknowledges that they have read, understood, and agreed to this Shipping Policy and all related Terms and Conditions.
